Terms of Use

Overview

ProgressCam ("the App") is developed and operated by Kerem Uslular ("we," "us," "our"). These Terms of Use ("Terms") set out the rules for using the App and its related services, including optional cloud backup and ProgressCam Pro. Please read them together with our Privacy Policy, which explains what data we collect and how we handle it. You can contact us at [email protected].

1. Accepting These Terms

By downloading, installing or using ProgressCam, you agree to these Terms. If you don't agree, please don't use the App.

ProgressCam is not directed at children under 13 (or the applicable age of digital consent where you live). If you are under the age of majority where you live, please use the App only with the involvement of a parent or guardian.

Which terms apply. If you downloaded ProgressCam from Google Play, these Terms govern your use of the App. If you downloaded it from the Apple App Store, Apple's standard Licensed Application End User License Agreement (the "Apple EULA") applies, together with these Terms where they don't conflict with it; if they conflict, the Apple EULA prevails for the iOS app.

2. The Service

ProgressCam helps you take consistent, aligned progress photos and compare them over time. In short:

We grant you a non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, in line with these Terms and the rules of the store you got it from. You may use the App for personal purposes and in your work or business — for example, as a clinic, trainer, salon or contractor. Whatever the use, these Terms apply: in particular, you must use the App lawfully (section 6), and you're responsible for having the consent of the people you photograph, such as your clients (section 5). We may add, change or remove features over time.

3. Accounts

Signing in is optional. You can sign in with Apple or with Google; we never see your Apple or Google password. Signing in lets you use cloud backup and restore your projects on another device.

Even if you never sign in, the App creates a random anonymous identifier so it can work with our servers, as described in the Privacy Policy.

You're responsible for keeping your Apple or Google account secure and for activity under your ProgressCam account. If you think someone has accessed it without your permission, contact us.

4. Deleting Your Account and Data

In the App. On iPhone or Android, if you signed in, go to Settings → Account → Delete Account, then sign in again to confirm. This permanently deletes your account, your cloud backup and your account profile. If you never signed in, go to Settings → Privacy & Lock → Delete My Data to delete your anonymous identifier and anything stored with it on our servers.

Without the App. You can also ask us to delete your account and its data by emailing [email protected]. To protect your account, the request must come from, or be confirmed from, the email address on your account. We complete email requests within 30 days; deletion in the App is immediate. Our account deletion page explains how to ask, what is deleted and what is kept, and our Privacy Policy (section 8) has the details.

Deleting your account doesn't delete the projects and photos stored on your device (delete them in the App, or delete the App), and it doesn't cancel a subscription — cancel it in your store's subscription settings first (section 7). Your Pro purchase is tied to your App Store or Google Play account, not to your ProgressCam account.

5. Your Content

Your photos, notes and project data ("your content") belong to you. We don't claim ownership of them.

If you use cloud backup, you give us a limited, non-exclusive, royalty-free, worldwide licence to store, copy and transmit your content, only as needed to back it up, sync it and restore it for you. We don't use your content for anything else: we don't sell it, use it for advertising, or show it to anyone. This licence ends when you delete the content from the cloud or delete your account.

You're responsible for your content and for having the right to capture and store it — for example, the consent of anyone else who appears in your photos.

Keep your own copies of anything important. You can save a copy of your photos as a ZIP archive at any time from the App's Settings.

6. Acceptable Use

You agree not to:

If you break these Terms, we may suspend or end your access to cloud backup or your account. Where appropriate, we'll tell you first.

7. ProgressCam Pro

ProgressCam is free to use, with limits. ProgressCam Pro removes those limits and unlocks extra features, as described in the App and on our Support page. Pro is available as:

Free trial. Where offered, the annual subscription starts with a 7-day free trial for eligible new subscribers; the store decides eligibility. Unless you cancel before the trial ends, the paid annual subscription starts and you're charged when the trial ends.

Billing. Payments are processed by the store you bought through — the Apple App Store or Google Play — and charged to your account with that store. We never receive or store your payment details. The App shows the current price in your local currency before you buy. The store's own terms also apply to your purchase.

Cancelling. Cancel a subscription in the subscription settings of the store you subscribed through (in ProgressCam: Settings → Manage subscription). On the App Store, cancel at least 24 hours before the end of the current period or trial to avoid the next charge; on Google Play, cancel before the renewal date. You keep Pro until the end of the period you've already paid for. Deleting the App or your account doesn't cancel a subscription. The lifetime purchase has nothing to cancel.

Refunds. Refunds follow Apple's and Google Play's refund policies: request a refund for an App Store purchase from Apple, and for a Google Play purchase through Google Play. If you have a problem with a purchase (for example, Pro doesn't unlock after you've paid), contact us at [email protected] and we'll help where we can.

Price changes. We may change the price of Pro. A price change never affects a period you've already paid for. For an existing subscription, the store will tell you in advance and, where its rules require, ask for your consent; if you don't want to pay the new price, you can cancel before it takes effect.

If your subscription ends. Nothing is deleted. Your projects and photos stay on your device, your cloud backup isn't deleted, and you can keep viewing and comparing them and exporting within the free limits. The free limits apply again to new additions, such as new projects, new photos beyond the free limit, and new sides. New photos may stop backing up while you're over the free cloud storage limit. You can subscribe again, or buy lifetime Pro, at any time.

Restoring. Use Restore Purchases in Settings to restore Pro on another device signed in to the same App Store or Google Play account.

iPhone and Android. Pro is tied to the store you bought it from. A purchase or subscription from the App Store doesn't unlock Pro on Android, and one from Google Play doesn't unlock Pro on iPhone. Your photos can still move between devices with cloud backup when you're signed in to the same account on both.

8. Third-Party Services

ProgressCam relies on third-party services, including:

Your use of these services is also subject to their own terms and privacy policies. We don't control them and, except where the law says otherwise, we aren't responsible for them.

9. Disclaimers

ProgressCam is not a medical device and does not provide medical advice, diagnosis or treatment. Photos, alignment, comparisons, recaps and any weight shown in the App are for personal tracking only. If you're tracking a skin, hair, dental, body or other health concern, talk to a qualified professional, and don't ignore or delay professional advice because of anything you see in the App.

The App is provided "as is" and "as available." To the extent the law allows, we make no warranties, express or implied — including that the App will be error-free or uninterrupted, that alignment will always be accurate, or that cloud backup will never fail or lose data.

Nothing in these Terms affects rights you have as a consumer that can't be excluded or limited under the law where you live.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, photos, profits or goodwill, arising from your use of, or inability to use, the App.

To the maximum extent permitted by law, our total liability to you for any claim relating to the App is limited to the amount you paid for ProgressCam Pro in the 12 months before the claim.

Nothing in these Terms limits or excludes liability that can't be limited or excluded by law, such as liability for fraud, for intentional misconduct or gross negligence, or for death or personal injury caused by negligence.

11. Changes to These Terms

We may update these Terms to reflect changes to the App, our services or the law. We'll update the "Last updated" date above and describe material changes, for example in the App's release notes. If you keep using ProgressCam after changes take effect, you accept the updated Terms; if you don't agree, stop using the App and cancel any subscription.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul, Türkiye, have jurisdiction over any dispute arising out of or relating to these Terms or the App.

If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you live, including any right that law gives you to bring a claim before the courts or consumer dispute-resolution bodies there. Nothing in these Terms limits any rights you have that can't be excluded or limited by law.
